Business Methods and Software Patenting

چکیده
Naturally occurring items such as plants or minerals are, in general, ineligible for utility patent protection because they are viewed as belonging in the public domain. There is a dichotomy between those items that are naturally occurring, and consequently unpatentable, and those items that are not found in nature, which are patentable. Portions of items found in nature are eligible for patent protection if their claimed form is changed from their natural form. Thus, some items ‘discovered’ in nature may be patented when the patentee both finds them and purifies or extracts them from their natural state.

Will the Open Source Movement Survive a Litigious Society?
Since no one is willing to undertake costly research and development to create innovation, incentives in the form of patents were instituted to motivate R&D. In software development, contrary to economic intuition, open source software has emerged as a viable alternative source of innovation. The patenting system has performed reasonably well in enhancing many other technologies. Since the mid-...
متن کاملPatents and the Survival of Internet-related Ipos
We examine the effect of patenting on the survival prospects of 356 internet-related firms that IPO'd at the height of the stock market bubble of the late 1990s. By March 2005, nearly 2/3 of these firms had delisted from the NASDAQ exchange. Although changes in the legal environment in the US in the 1990s made it much easier to obtain patents on software and, ultimately, on business methods, le...
متن کاملOptimal Patenting and Licensing of Financial Innovations1
Recent court decisions, starting with the State Street decision in 1998, allow business methods to be patentable and now give nancial institutions the option to seek patent protection for nancial innovations. This new patentability paradigm and the heterogeneity of characteristics associated with nancial innovations, poses an immediate decision problem for senior management: what to patent. ...
متن کاملPatenting of Biological Material and Biotechnology
One of the major challenges faced by developing countries due to globalization and TRIPS regulations is understanding of intellectual property rights (IPR) laws of different countries in context of recent innovations in biotechnology and bioinformatics. While biotechnology involves application of technology on biological organisms, viz., microorganisms, plant and animals and biological material...
متن کاملNber Working Paper Series the Impact of Academic Patenting on the Rate, Quality, and Direction of (public) Research
We examine the influence of faculty patenting activity on the rate, quality, and content of public research outputs in a panel dataset spanning the careers of 3,862 academic life scientists. Using inverse probability of treatment weights (IPTW) to account for the dynamics of self-selection into patenting, we find that patenting has a positive effect on the rate of publication of journal article...
متن کاملStrategic Patenting and Software Innovation
Strategic patenting is widely believed to raise the costs of innovating, especially in industries characterised by cumulative innovation. This paper studies the effects of strategic patenting on R&D, patenting and market value in the computer software industry. We focus on two key aspects: patent portfolio size which affects bargaining power in patent disputes, and the fragmentation of patent r...
